Canada Open Work Permit Eligibility for Foreigners
Canada Open Work Permit Eligibility
The Canada open work permit eligibility is part of Canada’s way of creating a smooth process for skilled workers and their families to have a steady income. Canada open work permit eligibility is determined based on a person’s residence status in the country. There are 2 main categories of people who qualify for the open work permit and these are:
1- People whose spouse or common-law partners or close family have obtained a work permit under a skilled category.
2- People who already possess a work permit that is about to expire.
Why an open Work Permit is issued
The open work permit is issued to enable the holder work for any employer in Canada as opposed to a particular one.
Also, the Canada open work permit eligibility is based on the idea that the spouse of someone already allowed to work in Canada will accompany them and may also want to engage in gainful employment so to enable the transmission for the couple to be smooth, an open work permit is issued for the spouse as well.
The other reason is to help a person who is in the process of having their residence status reviewed, to still engage in employment during the period that they are awaiting a decision on their permanent residence in the country.
Let us now take a closer look at the 2 categories of the Canada open work permit eligibility.
Eligibility for spouse and close family
This category is mainly for people who share a close family tie and should not be split up for example spouses, common-law partners as well as children who are of working age. In this category, if for example a doctor is given a work permit under the skilled worker program, this doctor, if married would be entitled to come to Canada with his spouse and maybe even children. Canada believes that families should not be split up so while these family members will be entitled to residence in Canada for the period that the doctor will be working in the country, they can also apply for an open work permit which will allow them to work for any employer for the period that the doctor is employed in Canada. For Children, this applies in some states like Alberta and Ontario.
Eligibility for people who already have a work permit
Under normal circumstances, the work permit issued to migrant workers is closed in that they can work for a specific employer and for a specific time. When this original permit is about to expire and the individual has filed an application for permanent residence, that’s when the Canada open work permit eligibility kicks in. Since the applicant cannot remain without work, they are allowed to apply for an open work permit which is referred to as the “Bridging Open Work Permit.” This permit allows a worker to carry on working as they await the decision on their immigration and even after their closed work permit has expired. It usually lasts for a year as that is enough time to get a decision from the immigration department. Remember though that this Canada open work permit eligibility is for people who are already in the country and have a temporary work permit already.
